Q: Is there some kind of lemon law that should apply?
I bought a car in Illinois with 56k miles on it. The dealership did not disclose that the car would require a timing belt change at 60k miles. Is there some law that they should have fixed or mentioned the repair need before they sold the car?

A: It isn’t up the the dealer to keep you informed of what maintenance your vehicle requires. I understand that needing this repair so quickly after purchasing the car is a bitter pill to swallow, but it’s simply why used vehicles cost considerably less than new vehicles.

Q: If I’m buying a car out of state is there anything special I should know?
Ok I found a car that’s litterally right on the “border” of Missouri in Illinois. I was wondering is there anything special I should consider before purchasing this vehichle?

I’m not buying it from a dealership, I found it on craigslist, is that a big deal? The drive isn’t to far so i can look at the vehicle before I buy it of course!

A: Make sure to check it over well before you hand over any cash. Arrange to have it looked at by a qualified shop (not one recommended by the seller). Make sure all the papers are in order. Run a vehicle report to check for title or odometer issues. Drive it and make sure it isn’t just around the block. Get it warmed up and up to speeds that you will be driving it at daily on freeways. Make sure everything works properly. Despite what another implies, there is no recourse once you buy it. The vehicle will be as-is with no warranty so if you do have a problem after you buy it, it is your responsibility to fix it.

Q: Labor Ethics Complaint?
How can I file a complaint against my job. I work in Illinois at a car dealership as a secretary. We work 6 hour shifts from 3 to 9 without a break ( we are told not to leave our office even). Then we work saturdays from 8 am to 6 pm once again with no break at all and are told to stay in our office. I want to know how to get them in trouble!

A: there is such a thing called the labor board in your state. Oh you live in ill. Forget it you live in a corrupt state run by corrupt politicians.

Q: How do I get a new key?
I lost my only set of car keys. The dealership is in Tennessee and I now live in Illinois. I don’t have a lot of money what are my options? 98′ Lumina 3.1L – the original key had a chip on it and I’m hearing something about a resister code.

A: Just go to your local Chevy dealer they can make u a key by giving them your VIN number….At least thats what the ford dealer did when I lost my only key..And they didnt even charge me!

Q: i want to cancel auto contract due to experience with dealership and i believe that we have no valid contract.?
Okay i bought a car roughly jan/feb 2010 and i have been trying to cancel a service contract for months. I finally won to get the service contract refunded by redoing the auto contract but now i want out of the contract all together. I see it this way, if they are redoing the contract , they need my signature right? So i feel that they were dishonest and choose to not deal with them anymore. I have lost sleep , time and money over all this. So i do not want to resign the contract therefore i would need to return the car. Now how should i go about this before dropping the car off. Do i call the police , attorney or both? I have an employee from the il. director of insurance office on my side , she can prove that the auto service contract needs to be redone. This issue is with a dealership in Illinois. All info is appreciated!
neels : i have read the contract , the dealership told me that the service contract could not be cancelled and once the il director of ins staff member contacted them and threatened with fines they magically said oh yes it can be cancelled. Thanks for your input.
Let me add: the service contract is part of my loan /auto contract , if it is altered it needs to be redone . I will refuse to sign it therefore no contract.

A: I’m not sure which is the bigger fool… The people giving legal advice on this forum, or the person who accepts it as true.

You need to talk with an attorney, and preferably one who specializes in contract law.

Q: Bought a lemon (Illinois), do I have any rights now that it is repaired?
I bought a car from JD byrider in Feb of 07 ( 2002Chrysler 300m). After having the car in my posession about a month, I learned I had a 2,000 dollar problem. I took the car to the dealership (someone other than who they referred me too) and had the car checked and fixed. Last month the car needed a head gasket replaced at the cost of 6,000 dollars and I was out of my car for 3 weeks (walking, while still making a payment of 464 monthly. A warrenty they sold me covered all of the repairs except the 500 I paid (things that weren’t covered. I have my car back and everything is fine.The repairs were not deemed my fault but as problems that already exsisted. My question is… didn’ they sell me a lemon? What are my rights under the law in Illinois, and if any whom do I contact regarding being sold a bad car. The warranty company is whom repaired the car (jd had nothing to do w/ repairs). I just feel ripped off, and it would be nice to be compensated for my loss of a car.

A: I live in IL and did some research on this because I was looking to buy a used car. The lemon law only applies to NEW vehicles. Your best bet is to contact the BBB, let them know about the company. For more info, google lemon laws in IL.

Q: Anyone know of the exemptions 4 window tint?
I read an article about window tint on driver’s side window and it said something about models made 1998 or older were exempt but by Jan 1, 2008, the exemptions expires and all tint must be removed. I own a 1997 dodge ram for 5 yrs & just NOW got pulled over 4 having tinted driver side window. I cannot find the article I had read about the tint exemptions. I also purchased this truck from an authorized car dealership, so if this is so illegal, do they have the right to sell this to me? Need some advice… oh, I am in Illinois. TIA……..

A: It makes a difference where you live, but the website below had a listing for various states including Illinois. If the information is correct, you may need to make a change right away. If the dates are correct that this began in 1998 then the dealer may be liable. I would at the least go back and ask them what kind of deal they could make on removing it and take the rules with you to try and leverage no cost to you.

Q: Can I return a BMW if I only had it so far for 20 hours?
My husband and I purchased a used BMW X3 last night in Illinois. The ride is terrible. It’s so bumpy I’m getting car sick. I simply cant drive it. When I test drove it, the salesman told me the road by his dealership was bumpy, not the car. I just want a different vechicle. Even if I have to pay more for the next car, that’s OK if I don’t get sick driving the damn thing. Can I return a car in Illinois? Thanks

A: there is no 72 hour rule that is fore door to door sales only. if you buy a car from that dealer they might work something out so you don’t loose your shirt but you will likely take a financial hit b/c they might not give you what you paid for the X3 toward the new car. defiantly call your salesman they may even have a return policy the dealership i work for allows exchanges of used cars toward anouther car at our dealership. we even offer full refunds if you have the car only one day but there is no legal precedence its completely up to the dealer.

Q: I have tried to sell my car in 3 states. Any ideas on how to sell privately?
I’ll try to make this a short story. I have an Olds Alero that I financed 4 years ago (it is a 2004, but I bought it slightly used). I got a bit cornered because I didn’t have hardly any credit at the time and had just had my old car totaled so needed one immediately. This was the only car at the dealership that was in a decent price range that they would finance me for.
Anyway, I moved from GA to OR two years ago and I had been trying to sell it there (craigslist, sign in the window, school boards, etc.) with no luck.
So I drove it to Illinois on my way (where I’m from) and tried to consign it on a friend’s lot for 8 months. No takers.
My dad drove it out to me here in Oregon (hell I was still making payments, might as well have a car). I’ve tried putting it on c-list again and not even had one response.

I’m ahead in my payments, but so far along that refinancing does me no good. I only owe about $4500 on it and it’s worth about $6K according to blue book.

How do I get rid of this damn thing? I don’t really need a car, and don’t want to make these payments anymore!

A: Key issues, you are paying for insurance on this, the value of any car is drops each month, and Olds are no longer being made. Now you hope it does not need a repair, more costs down the drain.
Forget the ticky-tack advertising, ie window sign and bulletin boards.
Get the car detailed, $100-200 dollars.
Put an ad in the largest paper for seven days. Price the car low to start.
Take good photos and put them on photo bucket, you can send callers to your location.
If that does not work, put it on AutoTrader. Buy the run til it sells package. Post the ad then every week lower the price $100.

Q: whats your worst car buying experiance?
I went threw one that went so wrong, “bait and switch” That the salesman I was working with actually assalted the dealership owner, and quit his job. (a mitzubishi dealer in Sycamore illinois that is no-longer in bussiness.) Plus, I had to file grand theft charges with the Police that they stole my trade-in, by dealer trading it before the deal was finial.
I have the title to that trade-in vehical still.

A: When I was in college, my roommate got drunk, stole my beloved 79 Ford LTD and crashed it into two parked semis and a brick wall, rendering it useless. Of course he didn’t have insurance… hell, he didn’t even have a license, seeing as getting drunk and stealing cars was a bit of a hobby for him.

I had about $600 to find a replacement. Of course there’s not much in that price range… I found a piece of crap Audi that my brother tried to talk me out of. I really should have known better when the owner made me sign a release stating I was accepting the car as is, but I was running out of time and hadn’t found anything else. (And I’d only paid about $575 for the LTD, so I thought maybe I’d get lucky again.) I bought the piece of junk and it proceeded to break down on me about a week later (on Christmas Day, no less) and after sinking money into the towing, it turned out it would cost a couple thousand just to get it running. Thankfully the roommates mom took pity on me and bought me another used car to make up for her son’s nonsense, and that one lasted a few years.

Q: Legal Liabilities of an Auto Dealership?
I bought a used 2005 Toyota Scion XB, 4-door from a GM-Chain dealership around 8/06.

Recently, I got pulled over by a county officer because of the tinted driver-side, and front passenger-side windows, which are considerably lighter than the privacy glass of the remaining windows of the car. I found out that having tinted windows on the front doors and windshield is illegal in the state of Illinois. My windshield was replaced, so I know it doesn’t have tint, but the windows still do.

The car was originally sold from a Toyota Dealship in Seattle, WA, and was re-sold here in Illinois.

I bought the vehicle, which still had its manufacturer’s warranty, as is, and have made no changes to the exterior, or windows.

My question: Is the dealership that I bought my car from, legally liable to sell me something that is legal to drive in the state its being sold in?

A: No.

Q: Car Can’t Pass Emissions Test, Please Help?
96 Geo Tracker failed test cause of EGR flow.Had EGR Bypass and EGR control valve replaced.After driving car for a week engine light came on.Tested again and failed again cause of EGR flow.Had o2 sensor replaced. Drove for a few days,engine light came on again. Tested again and failed, again for EGR flow and now system too lean.Dealership can’t find the problem,but recommended I have fuel injector service,engine decarbonization,and new hoses they didn’t specify which ones.I’ve spent over a grand trying to fix and I don’t want to give the dealer any more money because they haven’t been able to fix it.Trying to qualify for a waiver from the Illinois emissions but they won’t give it to me unless the engine light is off,it doesn’t matter if the car fails. What should I do?Can I perform the engine decarbonization and injector service myself, and if so how?and will that even make a difference?Is there a way to turn off the engine light without disconnectin battery to get qualify 4 waiver?

A: If I were u,i will remove the bulb which is giving you the run around.
Go for the test without the bulb,so light not there to fail you.
once passed,u can fix it back.
Now this electronic systems can show light for various reasons.From Loose tank caps to Co2 sensors.
Even auto transmission sensors show check engine lights.
The diagonise will show exact.
Only possibilty check auto transmission sensor.This could be the culprit.
try the bulb trick and get your vehicle moving.

Q: What can I do to get my name off an auto loan and put it in my cosigners only?
My boyfriend cosigned the loan on my car. We broke up and he took the car and moved across the country with it. I’m fine with that as long as he puts the loan into his name only and my name comes off everything so I’m not liable. There is $1645 left on it. Can we just get the dealership to take my name off and put everything in his name? How would he go about ‘refinancing’ it so I can get my name off?

Also, am I vulnerable from a legal standpoint? Can I get sued for any accident the car is involved in? I don’t know if he’s paid the insurance but he told me that in Illinois only the driver is at fault.

Anyone know?

A: The ONLY way to get your name off the title and off the loan is if he refinances the car IN HIS OWN NAME. There are no ifs ands or butts to this situation.

The only way to know if you are legally liable for the car as far as accidents go is if the state the accident was in automatically imputes liabilty to the registered owner. If it does automatically carries over to the registered owner then you are on the hook. If it doesn’t, it falls solely with the driver. In most states however, it does ultimately fall on the owner of the car and no one else. It would be up to YOU to sue the driver for damages.

Q: I put a down payment on a car, can I get it back?
I’m only 20 and yes kind of stupid because I put a down payment on a car of $1000. The dealer told me to so they could hold it for me. Anyways I found the dealership to be a bunch of a-holes and I found a better deal on the car. Will I be able to get my money back? It was paid on a card and the receipt does not say refundable or non refundable. But since it does not say non refundable that is a good thing right? I live in Illinois if that makes a difference?

A: Did you sign anything when you put the money down? If you did, read the fine print. After reading the fine print, call the dealership and ask them to cancel the transaction. If they won’t It may be possible to contact your credit card company and dispute the $1,000. and have them refund the money. But….Do this ASAP

Q: i think i bought a lemon PLEASE HELP?
i bought a car from a dealership as-is. the next day i brought it to a mechanic and he said he found a fuel leak. he then informed me that it is against the law in illinois for a dealership to sell a car with either a known fuel leak or with brake problems. i tried calling a bunch of probono attorneys and lawyers but they have yet to call back and my window of opprotunity to stop the check is rapidly approching. HELP ME PLEASE

A: you just said the problem “known”. They may not have known about the fuel leak. If it didn’t fail the state inspection, they didn’t do anything wrong.’

why did you bring it to a mechanic the next day? that gets done before you pick it up.

regardless, it’s as-is, you;ll have to fix it.
